Ok so basically I'm hoping to get broadband as Orange has offered me an amazing deal BUT as you need a phone line to get broadband I am not willing to pay the £60 fee orange are charging to get someone to come out and tell me if our phone line is connected (we recently moved in to this house along with a new baby so phone lines wasn't on top of my list, lol) so I'm hoping that once I get a land line phone we'll hear a dial tone, but my question is: Say we do hear a dial tone which means our phone line is active, Whats next? How do I find out who hold the phone line? or would it automatically go back to BT when the previous tenent left?!

I'm pretty sure that if you check with BT they can give you the info you need. Odds are that the line belongs to them anyway.
